Comisiwn Elusenau
Comisiwn Elusennau Cymru a Lloegr yw'r adran llywodraeth anweinidogol sy'n rheoleiddio elusennau cofrestredig yng Nghymru a Lloegr ac sy'n cynnal y Gofrestr Elusennau Canolog.
Tan Ddeddf Elusennau 2006, cafodd Plwyfi'r Eglwys yng Nghymru statws “eithriedig”, a gadarnhawyd yn unol â Deddf Elusennau 1993 drwy offeryn statudol a gyhoeddwyd ym 1996. Disodlwyd Deddfau 1993 a 2006 gan y Ddeddf Elusennau 2011, ond mae'r darpariaethau uchod yn parhau ac mae OS 1996 wedi'i ddiwygio gan OS 2012 1734 ac eto gan OS 2014 242.
O dan Ddeddf 2011 mae rhaid i bob elusen sydd wedi'i heithrio sydd bellach yn Ardaloedd Weinidogaeth gydag incwm gros fwy na £ 100,000 gofrestru. Mae Ardaloedd Weinidogaeth gydag incwm hyd at y trothwy hwnnw yn parhau i fwynhau statws eithriedig o dan OS 2012 1734 fel y'i diwygiwyd gan OS 2014 242 tan 31 Mawrth 2021, pan fydd eu statws eithriedig yn dod i ben o'r diwedd a bydd gan bawb sydd uwchlaw'r trothwy cofrestru incwm £5,000 i gofrestru fel unrhyw elusen arall.
The Charity Commission
The Charity Commission for England and Wales is the non-ministerial government department that regulates registered charities in England and Wales and maintains the Central Register of Charities.
Until the Charities Act 2006, the Parishes of the Church in Wales enjoyed “excepted” status, confirmed in accordance with the Charities Act 1993 by a statutory instrument published in 1996. Both the 1993 and 2006 Acts were replaced by the Charities Act 2011, but the above provisions remain and the 1996 SI has been amended by SI 2012 1734 and again by SI 2014 242.
Under the 2011 Act all excepted charities which are now the Ministry Areas with a gross income for the year in excess of £100,000 have to register. Ministry Areas with income up to that threshold continue to enjoy excepted status under SI 2012 1734 as amended by SI 2014 242 until 31st March 2021, when their excepted status will finally come to an end and all those above the £5,000 income registration threshold will have to register like any other charity.
