Cofrestru Ardal Weinidogaeth
Roedd gan cyn-blwyfi ac eglwysi statws eithriedig gyda'r Comisiwn Elusennau a oedd yn eu galluogi i fwynhau buddion tebyg o elusennau cofrestredig llawn fel Cymorth Rhodd a RhBCRh heb y maich ychwanegol o gofrestru'n ffurfiol.
Gyda'r Ardaloedd Weinidogaeth yn dod yn weithredol dros y blynyddoedd diwethaf, daeth yn amlwg bod incwm y rhan fwyaf o'r Ardaloedd Weinidogaeth yn uwch na'r trothwy o £100,000 sy'n ofynnol i gofrestru gyda'r Comisiwn Elusennau fel Elusen.
Tasgau Cyn-gofrestru
Cyn cofrestru mae nifer o gamau mae angen cyflawni yn gyntaf. Mae'r rhan fwyaf o dasgau'n ymwneud â chasglu gwybodaeth am yr Ardal Weinidogaeth ac aelodau o Gyngor yr Ardal Weinidogaeth (CAW).
Penderfynwch ar y Cyfeiriad Cyswllt ar gyfer yr Elusen
Gallai hyn ymddangos yn amlwg ar y dechrau ond mae'n bwysig bod gan yr Elusen gyfeiriad cywir wedi'i gofnodi ar ei gyfer yn ystod y broses gofrestru. Rhaid i'r cyfeiriad fod â chod post dilys hefyd.
Cyngor yr Ardal Weinidogaeth Mabwysiadu Polisi Diogelu
Mae angen i Gyngor yr Ardal Weinidogaeth mabwysiadu Polisi Diogelu'r Eglwys yng Nghymru i sicrhau ei fod yn cydymffurfio â chanllawiau'r Comisiwn Elusennau ar Ddiogelu.
Gwybodaeth Ymddiriedolwyr
Y dasg gyntaf yw gofyn i aelodau'r CAW gwblhau Ffurflen Manylion Ymddiriedolwyr. Bydd arnoch angen yr holl wybodaeth ar y ffurflen hon ar gyfer pob ymddiriedolwr yn ystod y broses gofrestru. Mae'n bwysig bod gennych yr holl ffurflenni yn ôl gan yr holl Ymddiriedolwyr cyn dechrau'r broses. Mae ffurflenni Manylion Ymddiriedolwyr ar gyfer eich Ardal Weinidogaeth ar gael o Dŷ Deiniol.
Cyfrifon Blynyddol
Mae'r broses gofrestru yn gofyn am brawf o incwm. Mae tair ffordd o ddarparu'r wybodaeth hon:
- cyfrifon blynyddol diweddaraf
- datganiad banc diweddar
- cynnig ariannol ffurfiol gan gorff cyllido cydnabyddedig
Argymhellir defnyddio copi o gyfrifon blynyddol diweddaraf yr Ardal Weinyddiaeth a dylai gynnwys yr adroddiadau canlynol:
- Dadansoddiad o incwm a gwariant
- SOFA gyda cholofn ddynodedig ar wahân
- Mantolen (manwl)
Gellir llunio'r adroddiadau uchod gan Finance Co-ordinator. Bydd angen uno'r adroddiadau yn un ffeil i'w llwytho i fyny i wefan y Comisiwn Elusennau.
Cofrestrwch ar gyfer cyfrif ar-lein y Comisiwn Elusennau
Er mwyn cofrestru Elusen bydd arnoch angen cyfrif ar-lein gyda'r Comisiwn Elusennau. I gael un, dilynwch y camau hyn:
Agorwch eich porwr gwe ac ewch i'r dudalen we ganlynol.
Cliciwch ar y ddolen "Cofrestru fel Defnyddiwr Newydd".
Nesaf, rhowch eich cyfeiriad e-bost ac yna cliciwch ar y botwm gwyrdd OK. Yna byddwch yn derbyn e-bost o onlineservices@charitycommission.gov.uk yn cadarnhau eich enw defnyddiwr. Bydd yr e-bost hefyd yn cynnwys eich cyfrinair. Bydd angen y manylion hyn arnoch pan fyddwch yn cofrestru eich Ardal Weinidogaeth fel Elusen. Pan fydd gennych y pum darn o wybodaeth y sonnir amdanynt uchod, yna rydych chi'n barod i gofrestru gyda'r Comisiwn Elusennau.
Y Broses Gofrestru
Mae'r broses gofrestru yn newid wrth i amser fynd yn ei flaen gyda chwestiynau newydd yn cael eu hychwanegu at y broses a rhai yn cael eu tynnu i ffwrdd neu eu newid. Felly, ar ôl cwblhau'r tasgau cyn-gofrestru, byddai'n well cysylltu â'r Tîm Cyllid i drefnu amser cyfleus i'ch cynorthwyo gyda'r broses.
Registering a Ministry Area
Former Parishes and churches enjoyed an exempt status with the Charity Commission that allowed them to enjoy similar benefits of fully registered charities such as Gift Aid and GASDS without the extra burden of formally registering.
With Ministry Areas being operational for the last few years it has become clear that the income of most Ministry Areas is above the £100,000 threshold requiring registration with the Charity Commission as a Charity.
Pre-registration Tasks
Prior to registering there are several steps that need to be undertaken first. Most tasks relate to capturing information about the Ministry Area and members of the Ministry Area Council (MAC).
Decide on Contact Address for the Charity
This might seem obvious at first but it is important that the Charity has a correct address entered for it during the registration process. The address must have a valid postcode as well.
Ministry Area Council Adoption of Safeguarding Policy
The Ministry Area Council needs to have adopted the Church in Wales Safeguarding Policy to ensure it complies with the Charity Commission's guidance on Safeguarding.
Trustee Information
The first task is to ask MAC members to complete a Trustee Details Form. You will need all of the information on this form for each trustee during the registration process. It is important that you have all of the forms back from all Trustees prior to starting the process. Trustee Details Forms for your Ministry Area are available from Ty Deiniol.
Annual Accounts
The registration process asks for proof of income. There are three ways of providing this information:
- latest annual accounts
- a recent bank statement
- a formal offer of funding from a recognised funding body
It is recommended that a copy of the last inspected Ministry Area annual accounts is used and should contain the following reports:
- Analysis of income and expenditure
- SOFA with separate designated column
- Balance sheet (detailed)
The above reports can all be generated from Finance Co-ordinator. The reports will need to be merged into one file to upload onto the Charity Commission website.
Register for a Charity Commission online account
In order to register a Charity you will need an online account with the Charity
Commission. To get one, follow these steps:
Open your web browser and go to the following webpage.
Click on the "Register As a New User" link. Next, enter your email address and then click on the green OK button. You will then receive and email from onlineservices@charitycommission.gov.uk confirming your username. The email will also contain your password. You will need these details when you register your Ministry Area as a Charity. When you have the five pieces of information mentioned above you are then ready to register with the Charity Commission.
Registration Process
The registration process changes as time goes on with new questions being added to the process and some being taken away or changed. It would therefore be best that once the pre-registration tasks have been completed that the finance team is contacted to arrange a convenient time to assist you with the process.
